What are important considerations and potential complications of management?

A 38-year-old woman presents to the office with complaints of weight loss, fatigue, and insomnia of 3-month duration. She reports that she has been feeling gradually more tired and staying up late at night because she can’t sleep. She does not feel that she is doing as well in her occupation as a secretary and states that she has trouble remembering things.

She does not go outdoors as much as she used to and cannot recall the last time she went out with friends or enjoyed a social gathering. She feels tired most of the week and states she feels that she wants to go to sleep and frequently does not want to get out of bed. She denies any recent medication, illicit drug, or alcohol use. She feels intense guilt regarding past failed relationships because she perceives them as faults

She states she has never thought of suicide, but has begun to feel increasingly worthless.

Her vital signs and general physical examination are normal, although she becomes tearful while talking. Her mental status examination is significant for depressed mood, psychomotor retardation, and difficulty attending to questions. Laboratory studies reveal a normal metabolic panel, normal complete blood count, and normal thyroid functions.

·         Use one-inch margins.

·         Double space.

·         Use an easy-to-read font between 10-point and 12-point.

Note: Title page is not required, but make sure you include your name and a title that reflects your topic at the top of the first page.

Shortly afterward, Emmanuel woke up wheezing and coughing. As he gasped for air, he became more and more anxious. His mother ran for his inhaler, but he was too upset and restless to use it. Emmanuel’s skin became moist with sweat, and as he began to tire, his wheezing became quieter. His mother called 911 and waited anxiously for the ambulance to arrive.

What is a hospital’s responsibility in insuring informed consent?

We will continue to review Case law as a foundation for understanding various concepts necessary to understand the law in regard to healthcare administration. The Canterbury v. Spence case in the background materials dates to 1972, but is considered a “landmark” case in that it established the important concept of the “reasonable person” in regard to informed consent. As clearly explained, the lack of informed consent creates an environment where care providers can be held liable for negligence or torts against a patient.

After reviewing the background readings and doing independent research, examine the case Canterbury v. Spence and answer the following:

Provide the background information regarding the case and the decision of the court.
Explain informed consent and its required elements.
What is the reasonable person standard?
Why is informed consent important in medical care?
What is a hospital’s responsibility in insuring informed consent?
Be sure to cite the peer-reviewed literature.

What could be said about our own society and tradition as it relates to the story?

Essay Assignment #1 (option #1) Description

Your first essay assignment option is to use the topic of tradition and relate it to “The Lottery.”  As you consider this topic, know there are many different approaches you might want to take in developing your thesis.  Here are some things to think about as you decide:

  1. What could be said about our own society and tradition as it relates to the story?
  2. Does everybody in the story feel the same about tradition?
  3. How does tradition shape human behavior?
  4. What is the value of traditions?
  5. How can traditions be harmful?
  6. How does tradition change over time?
  7. What are the beliefs that support the traditions?
  8. What happens to those who defy tradition?
  9. What can we learn from examining the role of traditions in the story?

You might also find helpful the discussion posts and comments from your classmates in developing a thesis for your essay.

Once you have formulated your thesis statement, you will need to come up with three main points that support your thesis.  You will support these points with textual evidence from “The Lottery.”  The textual evidence is the WHY in what you think.  For example, I can infer the Watson father was last year’s “winner” because on page 265, Jack Watson is now drawing as the head of household.

For each of your three supporting points, you will need two pieces of textual evidence.

Thirteen states in America have no minimum age for the adult prosecution of children? How can this be remedied?

Thirteen states in America have no minimum age for the adult prosecution of children? How can this be remedied?

Before children are adults they don’t know what they are doing. Children shouldn’t be prosecuted as an adult because children aren’t mature enough to act as an adult. The frequency of young kids committing horrendous crimes has been on a steady rise for the past couple of decades. This has brought up a very controversial topic that people seem to be very passionate about, you justify trying them in a court designed for adult offenders? In order to better understand the passion behind this debate it is best to gain some insight from both sides of the fight. trying juvenile’s as adults. There are many differences between the justice system for juveniles and the justice system for adults, although many would believe that it is the same at it’s core, it is surely not. In juvenile courts there are no juries and no trials by jury either. In adult courts the sentencing is much harsher and the chance of getting off the hook with some counseling is very slim. If a juvenile is defined as a person under the age of 18, how can

What are the methods used to identify, record, and communicate financial information?

Principal of Financial Accounting

You work as the accountant of a sole proprietorship, Jamie’s Consulting. Jamie’s Consulting has decided to expand and would like to obtain a line of credit with the bank. To apply for a line of credit, the bank requires the most recent set of financial statements. To help the owner, Jamie, accurately convey the business’s performance and overall financial health to the bank, she has asked you to review the business’s recent transactions and write a brief that will prepare her for her meeting with the bank.

Directions

Financial Review: Jamie emails you the quarterly business transactions to review. Jamie is currently traveling for business and would like the information from the review in a clear and concise manner. Use the Financial Review Template to review the transactions and provide sufficient reasoning for Jamie to understand your rationale for deciding to share the financial information with the bank. To ensure the financial information is accurate, reliable, and relevant, include the following in your review:

Apply the most relevant accounting principle from GAAP to each business transaction.

Explain your rationale for applying each accounting principle.

Use the accounting principles to decide to include or omit each business transaction.

Determine the appropriate account types for each business transaction. Note that each transaction will correspond to more than one type of account.

Refer to the accounting equation to determine whether each account type results in an increase or decrease of the account.

Brief to the Owner: After you send the financial review information, Jamie follows up with you via email. She is unfamiliar with financial accounting practices and asks you to write a brief that will prepare her for communicating the reliability of the financial information to the bank. As an accountant, you are responsible for effectively conveying the importance of accurate financial information. Specifically, Jamie asks you to address the following in your brief:

Explain the importance of applying GAAP to justify the accuracy, reliability, and relevance of financial information.

Describe the limitations or risks of applying GAAP. Address Jamie’s concerns by discussing the following:

What are the methods used to identify, record, and communicate financial information?

What are the implications for omitting one or more of the generally accepted accounting principles?

What uncertainties and risk factors are associated with reporting financial information?

What to Submit

Every project has a deliverable or deliverables, which are the files that must be submitted before your project can be assessed. For this project, you must submit the following:

Financial Review

The financial information must be submitted using the Financial Review Template. Include references in the footnotes section of your review.

Brief to the Owner

Your brief to the owner should not exceed 250 words in length. Cite all references appropriately.

Law and Business Situations:Does the current contract allow public use of the photographs?

Law and Business Situations

AW Photography

You are a new attorney, and your client, Amy Watson, is looking for legal recommendations to support her in understanding her rights and responsibilities as a photographer and as a business owner.

She would like to use her photographs on her website to showcase her work, but she feels nervous about potentially violating copyright and intellectual property laws. She also wants to make sure she does not violate employee rights if there is an employee who does not want their photograph online. When Amy comes into your office, she brings a copy of her contract with Firm X that was drafted by another attorney she had been working with previously. Below is an excerpt from Amy’s contract with Firm X.

COPYRIGHT AGREEMENT

The photographs produced by AW Photography are protected by federal copyright law (all rights reserved). If the client purchased an image DVD, the DVD purchase entitles the client to use the photographs on social media and websites as long as the images remain unaltered and textual credit is explicitly given to AW Photography. Future Considerations

Currently, Amy operates her business as a sole proprietorship. She is the owner and has no employees. However, due to the growth of her business, her vision for the future includes potentially hiring someone to help manage day-to-day operations including scheduling, website maintenance, keeping of financial information, and oversight of potential future employees. In addition, she would like to hire two or three photographers so that she can book more photography sessions. Before she moves forward with her growth strategy, she is wondering if her new manager should actually be a business partner, and if her business should operate as a partnership instead of a sole proprietorship.

Amy would like your legal support with business applications as she considers moving her company forward. She travels widely for her business and has recognized a market demand for reasonably priced portrait and event photography. She is typically booked over a year in advance. She believes that there is a good business opportunity to either partner with other photography businesses or open other studios and hire studio managers to run those.

Directions

  • Legal Contracts: Amy asked that you explain the elements of the legal contract.
    • Describe basic elements that should be included in the contract for informing involved parties about legal issues and expectations.
    • Explain the purpose of the contract for informing involved parties about legal issues and expectations. Include the following in your response:
      • Does the current contract allow public use of the photographs? For example, could Amy post the photographs on her website for promotional purposes? Explain elements of the contract and describe their legal implications.
  • Intellectual Property and Copyright: Amy would like you to explain what she, as a commercial photographer, needs to know about intellectual property and copyright law.
    • Discuss the impacts and applications of intellectual property and copyright in business situations, differentiating between commercial and personal use.
    • Describe how Amy may legally use the photographs taken for Firm X. For example, may she use them for commercial and personal use, such as on social media?
    • Describe how Firm X may legally use the photographs that Amy took. For example, may it use them for commercial use? And may employees use them for personal use, such as on social media?
  • Business Applications: Amy’s photography business has been growing, and she is considering making changes. She has operated under a sole proprietorship but now wants to organize as another entity and hire additional employees. Amy has asked for your suggestions about an appropriate business entity to consider. Include the following to support her in making this decision:
    • Define the following business entities: partnership, corporation, and limited liability company. Based on this, make a suggestion for the best type of entity for Amy, detailing why this would be a good choice. Discuss partnership as a business entity versus sole proprietorship for informing current business implications as a sole proprietor and potential business implications of a partnership.
    • Discuss the basic employment laws—including OSHA, FLSA, and privacy laws—that Amy should be aware of as she considers hiring her own employees.
    • Describe how privacy laws impact Amy and her employees’ use of photographs taken for business clients.
